The Siaya High Court on Monday dismissed Jakoyo Midiwo’s petition challenging the election of Gem MP Elisha Odhiambo.
Lady Justice Esther Maina dismissed the case for lack of evidence.
She held that Midiwo did not submit sufficient evidence to nullify the election of the Gem legislator.
“There was no iota of evidence that there were irregularities during and after the election. There was no evidence that the respondent interfered with the process.”
Maina noted that the August elections were free and fair.
Midiwo was ordered to pay Sh3 million with the judge adding that the petitioner’s claims of voter bribery, violence and undue influence of voters was nothing but hearsay.
Midiwo had in his submissions argued that the MP bribed voters at the home of former Royal Media Services presenter Felix Oduor aka Jalang’o.
He claimed that Odhiambo paid the attendees Sh100 each in order for them to vote in his favour.
But the Gem MP disowned a video purporting he bribed voters ahead of the August 8 general election.
The recording was played in court as part of the evidence in the petition filed by Midiwo.
